Utah Judge Determines Convicted Killer with Dementia Is Competent for Execution


A Utah judge has ruled that Ralph Leroy Menzies, a convicted killer on death row for 37 years, is competent to be executed despite having developed dementia. Menzies, 67, was sentenced to death in 1988 for the murder of Maurine Hunsaker, a mother of three. Judge Matthew Bates stated that Menzies demonstrates a consistent understanding of his situation and his impending execution, asserting that he has not sufficiently shown a decline in his understanding that would violate the Eighth Amendment against cruel and unusual punishment.

Menzies had previously chosen to die by firing squad, making him the sixth U.S. prisoner to face this method since 1977. The Utah Attorney General’s Office plans to issue a death warrant soon. Menzies’ attorneys contend that his severe dementia prevents him from comprehending the reasons behind his execution and intend to appeal the ruling to the state Supreme Court. His attorney, Lindsey Layer, highlighted the troubling prospect of executing a “severely brain-damaged, wheelchair-bound” individual.

Historically, the U.S. Supreme Court has intervened to protect prisoners with dementia from execution, as seen in a 2019 case involving an Alabama man. Menzies has engaged in nearly four decades of appeals that have postponed his execution, which was previously scheduled multiple times. Maurine Hunsaker was abducted while working at a convenience store and later found murdered. Her son, Matt Hunsaker, expressed overwhelming emotion upon hearing that justice would finally be served for his mother’s tragic death.
